Fundatia Terre des hommes Romania, in cadrul proiectului ,,Suport pentru infrastructura socială, de sănătate și educație în județul Bacău” implementat  în județul Bacău, solicita oferta pentru construire/amenajare locuri de joaca in 5 comunitati din judetul Bacau, cu transport si montaj inclus. Scopul proiectului este sprijinirea serviciilor sociale, de sănătate și educație prin implementarea de investiții în infrastructura din 37 de localități (comune și orașe) din județul Bacău, atât în construcții, cât și în dotări cu un impact semnificativ asupra calității vieții copiilor.

În prezent, proiectul este la începutul celei de-a doua etape de derulare a investițiilor în infrastructură ce vor fi realizate în beneficiul copiilor din de 37 de localități din județul Bacău (comune și orașe) implicate în proiect.

În prima etapă a proiectului, au fost evaluate nevoile de investiții în infrastructură, în beneficiul copiilor, în fiecare dintre comunitățile cărora li se adresează proiectul. Acest proces a presupus realizarea, în perioada iulie – decembrie 2017, a unor serii de întâlniri cu autoritățile locale, grupuri de copii, profesori și părinți, precum și cu alți actori din fiecare dintre cele 37 de comunitate (ONG-uri, preoți, cetățeni etc). La finalul întâlnirilor a fost organizată o nouă întâlnire cu reprezentanții comunităților locale împreună cu care au fost decise investițiile cele mai relevante pentru comunitățile lor. Decizia finală a fost luată în acord cu nevoile și așteptările copiilor și în funcție de nevoile comune evidențiate în urma întâlnirilor avute cu grupurile menționate mai sus.

On June 4th 2019, Terre des hommes Romania (Tdh) hosted a conference with the Platform for International Cooperation on Undocumented Migrants (PICUM) about alternatives to child detention in the context of migration and asylum. Guests from around Europe were present to discuss the differences in policies in Belgium, Bulgaria, and Romania for accompanied and unaccompanied minors. There were also representatives from the Fundamental Rights Agency (FRA), Mineurs en exil, UNHCR Romania and Legal Resources Center (CRJ). This conference was part of an advocacy initiative called Safe, Not Detained which highlights that children are children before they are migrants and that children should not be detained. The initiative had three main elements which were drafting a road map of solutions, a child led campaign on the issue, and an advocacy event. Tdh also wrote a guide for judges and prosecutors which can be found here (in Romanian).

Child detention occurs during the migration process as either part of the reception procedure into the country, part of a Dublin transfer, or part of a return decision. Often, children are detained with their family or if there is confusion about their age. Staying in a closed detention centre can be a traumatizing and stressful experience for children and removes their rights. Child protection laws should be prioritized over migration laws, but they are often ignored. Tdh believes that there are different alternatives to keeping children in detention or public custody and that there needs to be more data collection on the issue.

During the conference, guests discussed on several practical alternatives to detention of minors. Speakers from Belgium shared that they are working on more alternatives, but are currently using return houses to host families who are in the removal process. In 2018, a repatriation centre with family units opened, but has since received criticism for being another kind of closed facility.

Another alternative idea is having a case manager assigned to each migrant who will help them through the process of immigration. Case management also helps with the next steps if migrants are not approved to stay in the country. This can help families trust in the system and can also be less costly. The UNHCR representative also noted that when alternatives to detention are applied that migrants are more likely to comply and work with authorities. Tdh is looking into alternatives that can be used in the Romanian context as detention is never in the best interest of the child. 

This conference was organised under Safe, not detained project. This project was funded by the European Program for Integration and Migration (EPIM), a joint initiative of the European Foundation Network, H&M Foundation in partnership with the Initiative for Children in Migration, Missing Children Europe and PICUM.

Prin proiectul Safe, not detained am scris un instrument de lucru pentru practicieni din domeniul justiției precum judecatori, procurori. avocați cu alterntive la detentie a copiilor migranți neînsoțiți sau însoțiți de familii.

Detenția copiilor în contextul migrației și azilului, inclusiv al acelora care sunt neînsoțiți sau care își însoțesc familiile, este un fenomen răspândit în țările Uniunii Europene. Cu toate acestea, nu există date statistice relevante despre numărul acestora, dar datele publicate de Agenția pentru Drepturi Fundamentale a Uniunii Europene (FRA), precum și de Quaker Council for European Affairs arată că practica există și este subraportată.Există divergențe semnificative între statele membre cu privire la metodologia de culegere a acestor date; în unele țări, copiii care sunt plasați în custodie publică împreună cu părinții lor nu sunt numărați separat pentru că nu fac obiectul unei ordonanțe de luare în custodie publică, ci sunt lipsiți de libertate pentru a fi împreună cu părinții lor, așa cum este cazul în România.

În România există foarte puține date publice cu privire la acest subiect. De exemplu, raportul Avocatului Poporului în urma vizitei din 19 septembrie 2017 în Centrul de Cazare a Străinilor aflați în Custodie Publică de la Otopeni arată că în centru, la data vizitei, se aflau 112 persoane din Pakistan, Irak, Iran, Mongolia, Maroc, Algeria, Bangladesh, India, Kosovo, Egipt, Tunisia, ca urmare a unor intrări în țară a imigranților pe Marea Neagră. Dintre aceștia, 46 erau minori care își însoțeau părinții plasați în custodie publică. Nu există informații cu privire la durata șederii minorilor în acest centru, dar raportul subliniază că: “Astfel, cazarea migranților aflați
în detenție administrativă este asimilată condițiilor de cazare penală, având în vedere oferta minimală a mobilierului, lipsa dotărilor suplimentare care să asigure norma corectă privind
viața privată” – Raportul Avocatului Poporului. 
Detenția migranților iregulari sau a solicitanților de azil apare în contextul impunerii deciziilor de returnare în țările de origine, la impunerea transferurilor Dublin sau ca parte a procedurilor de recepție pentru cei care urmăresc obținerea protecției internaționale.

În urma studiilor efectuate s-a constatat că luarea în custodie publică prezintă un impact negativ asupra dezvoltării și creșterii minorului. Impactul negativ este inclusiv asupra psihicului acestuia. Copiii ținuți în detenție sunt supuși riscului de depresie și anxietate ș prezintă frecvent simptome compatibile cu sindromul de stres post – traumatic (PTSD), cum ar fi insomnia, coșmarurile și enurezisul. Sentimentele de deznădejde și frustrare se pot
manifesta ca acte de violență impotriva lor sau a altora. Rapoartele privind efectele detenție în contextul imigrării asupra copiilor au constatat rate excesive de suicid, tentative de sucid și auto-vătămare, tulburări mentale și probleme de dezvoltare, inclusiv tulburare gravă de atașament.

In Romania, Terre des hommes (Tdh Ro) has been active since 1992. For the past few years, the delegation has been working on three main intervention areas: (1) Strengthening child protection and juvenile justice systems, (2) Protection of children affected by migration/trafficking, and (3) Social inclusion of minorities. Every year thousands of children and their families benefit from projects implemented either at a national or regional level.

ROLE DESCRIPTION

This post holder will mainly manage one project in Romania:

Under the MISTO project a transnational cooperation mechanism will be created to support education professionals and institutions in cities of origin and destination of Roma families on the move to ensure non-disruptive education for Roma children. Education professionals will be provided with concrete tools and methods for ensuring non-discriminatory quality education to these children through a comprehensive training programme, stimulating mutual learning and cooperation through a transnational community of practice. Prejudice-related difficulties in ensuring nondiscriminatory education for Roma children on the move will be tackled in through a child-led campaign.

MAIN RESPONSIBILITIES

• Responsible for the effective and qualitative implementation of project activities and for reaching project outcomes, ensuring high standards
• Responsible for steering the consortia of (international) project partners and internal team members; coordination and technical assistance
• Responsible for reporting to the donor and project & budget monitoring
• Sound liaison with local authorities, local NGO’s, community groups and beneficiaries
• Support the further development of Tdh’s Child and youth in Migration programme
• Explore opportunities for funding migration programme activities
• External communication, networking and advocacy

YOUR PROFILE

• At least 5 years of progressively responsible experience in leading child protection related projects and a successful record in delivering qualitative and tangible results.
• University degree from an accredited educational institution in a relevant field;
• Ability to learn, apply and fully comply with donor rules, regulations, legal framework, office policies and procedures. 100% transparency, rigor and honesty.
• Knowledge of (circular) migrant and refugee situation in Romania.
• Knowledge on gender and diversity a strong asset.
• Ability to innovate and to be creative.
• Ability to work in a team in a consensual manner and to encourage full participation.
• Ability to multi-task, handle pressure, work with limited supervision.
• Ability to communicate effectively both verbally and in writing in both English and Romanian.

Project description

PRECISION or Promote Rehabilitation, Empowerment of Children and Support for Youth Offenders is a project that seeks to promote wellbeing and reduce revidivism of juvenile offenders in Romania.

The objective of the project is that: by the end of 2020, about 500 children and youth in 3 juvenile detention facilities (Detention Center of Craiova, Detention Center in Tichilesti, Brăila and Educative Center in Târgu Ocna), benefit of high quality personalized services that meet their rehabilitative needs. During their detention, children and youth will have developed the necessary knowledge and skills (literacy, vocational skills, life-skills, self-esteem, motivation, social skills etc.) for their successful rehabilitation in society.

The project will apply a two-fold approach:

1) case management – social and mental health services, such as counseling, family and peer interventions and recreational activities

2) education and vocational training within the Detention Center in Craiova, Romania,  that serves as a pilot facility for the model.

Goal and objectives

The final aim of this pilot project is that during their detention, all children and youth will have developed the necessary knowledge and skills (literacy, vocational skills, life-skills, self-esteem, motivation, social skills etc.) for their successful rehabilitation in society.

This proposed project should be seen as an initial step in a longer term intervention. The two years will lay the foundations for a change (strengthening) of the juvenile justice system in Romania. Being a stable country politically, we have every reason to believe that our investment will bring endure over time, particularly for the fact that we respond to legally-binding needs.

The model we propose will be based on Terre des hommes’ conception of the child in conflict with the law as an active and positive contribution to society rather than being considered as a risk. As a consequence, all children in conflict with the law should be supported in their development of skills and competences.

The main objectives of the project are:

• To develop a knowledge base and tools that will serve for informed decisions for politicians and practitioners and promote better understanding of child and youth challenges in the justice system and upon exit.

• To develop a model that is based on individual case management and consists of a package of services meeting the rehabilitative needs of juvenile offenders. Alongside, to strengthen the capacities of professionals working with children and youth in detention facilities.

• To raise awareness and advocate on the specific needs of children and youth in detention and the importance of (pre-release) programs that target individual factors and aim at increasing self-esteem, improving mental well being and changing behavior.

The project is implemented by Terre des hommes Romania and financed by MEDICOR Foundation.
